Equitable distribution refers to the court-ordered or agreed-upon division of marital and divisible property associated with a divorce. Equitable distribution is one of the more complex areas of family law. It involves identifying, valuing, classifying and distributing the net marital and divisible estate equitably between the parties. It is important to remember that equitable does not mean equal; it means fair. While there is a presumption that the marital estate should be divided equally, there are factors for a judge to consider in making an unequal distribution of the marital estate.
