Equitable Distribution in 4 Easy Steps
One of my goals for 2019 is to sharpen my focus on complex equitable distribution cases. The identification, classification, valuation and distribution of assets in equitable distribution is a sequential process that I enjoy and understand. Each step of the process is important. Each step is nuanced. Presumptions abound. Opportunities for the trial court to exercise discretion in ways that can help or hurt your case are plentiful. Good lawyering in this area can make a tremendous difference to clients. Here is a manuscript I put together for a presentation locally on January 25th, 2019. The manuscript should be used as a reference point for discussion, and I am available for consultation.
